The Pharmaceutical Price Regulation Scheme (PPRS) Dispute Resolution Panel has handed down two panel decisions about a preliminary issue in relation to over and under delivery under the 2005 PPRS. The question raised was whether membership of the 2005 scheme constitutes a contract or not.

 

The decisions concerned two cases:

  1. Department of Health and Merck Serono Limited dispute resolution (PDF, 231KB)
  2. Department of Health and TEVA UK Limited dispute resolution (PDF, 231KB)
